什么是“性同意”？鲍某某涉性侵案引发全民大讨论

鲍某某被控性侵养女案引发持续热议。

最高人民检察院13日在官方微博发布消息称，针对鲍某某涉嫌性侵一案，最高人民检察院、公安部已派出联合督导组赴山东，对该案办理工作进行督导。

The Supreme People's Procuratorate and the Ministry of Public Security said on Monday that they have dispatched a joint team to Shandong province to supervise the investigation of a case in which a former company executive was suspected of sexually assaulting his "adopted" teenage daughter.

随着事件发酵，网上掀起了关于性侵犯和性教育等话题的大讨论。

其中，#什么是性同意#这一话题登上热搜榜，截至14日中午，阅读量达到7.2亿。

性同意（sexual consent /kənˈsent/ ）是指发生性行为前，获得和给予对方明确的同意。

Sexual consent is consent to engage in sexual activity.

其中，consent（同意）是指用明确的语言或行为表示同意做某事：

Consent is a clear and unambiguous agreement, expressed outwardly through mutually understandable words or actions, to engage in a particular activity.

Consent是通过互相都明确的语言或行为，表达出来的一种清晰明了、毫不含糊的意愿，同意与之参与某种行为。

关于性同意，有几个重要的概念需要了解一下。

没有同意就是性侵

很多人并不清楚什么样的情况可以被定义为性侵，还有不少人觉得一方如果没有奋力反抗，那就是半推半就，算不上被侵犯。

但实际上，没有征得明确的同意而发生的性行为，就是性侵。

Sexual assault is an act in which a person sexually touches another person without that person's consent, or coerces or physically forces a person to engage in a sexual act against their will.

性侵是指某人在未征得他人同意的情况下，对其进行性接触，或违抗其意愿，胁迫或强迫其发生性关系。

所以，性侵并不一定像电影里演的那样，发生在阴暗的小巷子里，受害者被坏人用枪指着头，场面暴力血腥。性侵很有可能发生在信任的人之间。

It can be “I trusted you” violence. It can be husbands and wives, boyfriends and girlfriends, best friends, and first dates.

施暴者也可能是你信任的人。性侵可以发生在夫妻之间、男女朋友之间、好朋友之间、或是初次约会的相亲对象之间。

性同意年龄

性同意年龄，即the age of consent，指在法律上达到有能力同意与他人发生性关系的年龄。

The age of consent is the age at which a person is considered to be legally competent to consent to sexual acts.

低于这一年龄者，被视为没有性同意能力，所以，无论其同意与否，成年人与之发生性关系都构成强奸。

Consequently, an adult who engages in sexual activity with a person younger than the age of consent is unable to legally claim that the sexual activity was consensual, and such sexual activity may be considered child sexual abuse or statutory rape.

所以，一个成年人与低于性同意年龄的人发生性关系，是不能够合法地说这种性行为是双方自愿的，而会被视为儿童性虐待或法定强奸罪。

consensual /kənˈsenʃuəl/：一致同意的

statutory /ˈstætʃətɔːri/ ：法定的

我国的性同意年龄是14岁。至于14岁以上不满18岁的未成年人，我国2013年颁布的《关于依法惩治性侵害未成年人犯罪的意见》也明确指出：

“对已满十四周岁的未成年女性负有特殊职责的人员，利用其优势地位或者被害人孤立无援的境地，迫使未成年被害人就范，而与其发生性关系的，以强奸罪定罪处罚。”

但中国政法大学教授罗翔认为，司法意见毕竟不是法律，其威慑力有限，有必要在刑法中增设滥用信任地位型强奸罪。

当双方存在特定关系，未成年人对特殊职责人员有关性的同意在法律中应视为无效，只要与未成年人发生性关系，特殊职责人员就应该以强奸罪论处。

罗翔谈利用特定地位性侵和所谓“师生恋”

罗翔认为，此处的特殊职责可以采纳司法意见的规定，也即对未成年人负有监护、教育、训练、救助、看护、医疗等特殊职责的人员。

同意可以随时撤销

过去同意与人发生关系，不代表现在也同意。而且任何一方都有权随时撤回同意。

You can withdraw consent at any point if you feel uncomfortable. It’s important to clearly communicate to your partner that you are no longer comfortable with this activity and wish to stop.

如果你觉得事情发展到让你感到不适，就可以随时收回之前的同意。所以，你要很明确地告诉对方，自己对于这种行为感到不舒服，希望停止。

穿着性感不代表同意

剑桥大学Cambridge for Consent组织称：

There is no evidential correlation between any types of clothing and rape cases.

并没有确凿的证据表明，穿什么样的衣服和强奸案件之间有关联。

就算是有，这也不应当成为被害者被指责的原因。女孩穿着再性感，也不代表她就同意和别人发生关系。

No clothing “asks” for rape, because rape by nature is non-consensual.

没有哪种穿着是想招来强奸，因为强奸的本质是未经同意的侵犯。

所以，劝告女孩们保守穿衣的人们也许出于好心，但却无法解决根本问题。

A culture that tells its children not to wear certain clothes isn’t solving the problem, but placing the responsibility on the wrong group.

人们告诫孩子们不要穿某种服装，这样的文化对于解决问题无济于事，它只是把责任强加于受害群体之上。

喝醉酒也不代表同意

一个人喝了酒，并不代表他/她就应当被性骚扰。

遇到一方醉酒，另一方的正确做法请了解一下：

If someone is not in a fit state of mind due to intoxication from alcohol or drugs, your priority should be to look after them and make sure that they are okay – not to exploit them and take advantage of them.

如果有人因为酒精或药物的麻醉而神志不清，你首先要做的是照顾他们，确保他们无恙，而不是趁人之危、占人便宜。

intoxication /ɪnˌtɒksɪˈkeɪʃən/：醉酒；中毒

exploit /ɪkˈsplɔɪt/：剥削

原因很简单：

Somebody unconscious or asleep is similarly unable to consent to sex.

头脑不清醒或睡着的人是无法同意与人发生关系的。
